TERMS OF SERVICE

Hi! Welcome to PROPS MEDIA LLC (“PROPS”).  PROPS provides its products (collectively, the “Service”) subject to these Terms of Service.

 

Payment

We only charge you when you purchase one of our products. Any payments due to PROPS in connection with the Service are payable in advance and are not refundable in whole or in part except as expressly specified in this Agreement. We offer multiple payment options.

 

Return policy

We care about the products we create and want you to receive them in the same quality as when they were shipped. We don’t offer refunds, but if you receive a product that is damaged, contact us (hello@props-media.com) and we will take care of replacing it.

 

International customers

Your use of the Service is governed by the PROPS Privacy Policy, which is available at https://props-media.com/pages/privacy-legal and incorporated by reference into these terms.

 

Use of copyrighted materials/trademarks

PROPS conducts in-depth research on the topics covered in its products. Any materials that are provided by PROPS, including without limitation any documentation, content, text, data, graphics, images, interfaces or other materials or works of authorship, (the “Materials”) are copyrighted materials owned by or licensed to PROPS.  All rights are reserved.  The Materials contain trademarks, service marks and trade names which are owned by PROPS, and may also contain brand and product names which are trademarks, service marks or trade names of third parties which are owned by their respective owners. We make every attempt to properly attribute in the products.  

  

Notices of copyright infringement

PROPS respects the intellectual property rights of others, and asks you to do the same. If you believe that your work has been posted on the Service in a way that constitutes copyright infringement, please contact PROPS at the address below and provide the following information: (1) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (2) a description of the copyrighted work that you claim has been infringed, and identification of the URL or other specific location on the Service where the material that you claim is infringing is located; (3) your address, telephone number, and email address; (4) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (5) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. Please contact: hello@props-media.com

PROPS is dedicated to in-depth research and telling of the origin story of iconic consumer products. Despite our best efforts to do so, PROPS offers no warranties on the accuracy of product content. We are not liable for omissions, inaccuracies, or typographical errors. All product content is provided “as is” and should be viewed as informational and entertainment.

 

Export control

PROPS operates the Service from its facilities in the United States of America, and partner services in Canada, and makes no representation that the Service is appropriate or will be available for use in other locations. If you use the Service from outside the United States of America, you are entirely responsible for compliance with applicable local laws, including but not limited to the export and import regulations of other countries in relation to the Service, and your Submissions (ordering, and use of Slack channel).

 

General provisions 

Enforcement of this Agreement will be governed by the laws of the State of Washington, USA, excluding its conflict and choice of law principles.  The exclusive jurisdiction and venue for any claims arising out of or related to this Agreement or your use of the Service will lie in the Superior Court of King County in the State of Washington, or the United States District Court for the Western District of Washington, and you irrevocably agree to submit to the jurisdiction of such courts.  The failure of PROPS to enforce any right or provision in this Agreement will not constitute a waiver of such right or provision unless acknowledged and agreed to by PROPS in writing.  In the event that a court of competent jurisdiction finds any provision of this agreement to be illegal, invalid or unenforceable, the remaining portions will remain in full force and effect.  This Agreement, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned in whole or in part by PROPS without restriction.

 

Modifications to Terms:  PROPS reserves the right, at is sole discretion, to change, modify, add or remove portions of this Agreement at any time. Your continued use of the Service following the posting of changes to the Agreement will be subject to the then current Terms of Service, which shall supersede all earlier versions.
